Habitat is free to play. The only thing it sells is packs of virtual cards, and every card in them can also be earned by playing. These terms cover those purchases, in plain words.
Habitat is not on sale yet. Nothing can be bought until the game is released. These terms apply from that day.
Who we are
Habitat is made by Eliarc Studios Ltd, a company registered in England and Wales (company number 17437056), registered office 71–75 Shelton Street, Covent Garden, London WC2H 9JQ. For anything about a purchase, write to contact@habitattcg.com.
Who you buy from
You buy packs inside the game, through the store you got Habitat from: Steam at launch, and Apple’s App Store and Google Play when the game reaches phones. That store takes your payment, sends your receipt and pays any refund, under the terms you accepted when you opened your account with it. We never see or hold your card details. We make the game and supply what you bought.
What you are buying
A pack is a sealed set of virtual cards for use inside Habitat. Before you pay, the pack’s page in the game’s Store shows you:
- its price, in your currency;
- how many cards it holds, and what it guarantees;
- the odds of each rarity, on the odds page it links to.
A bundle is several of the same pack bought together at a lower price each.
What you buy is the right to use those cards in the game on your own account. Cards are not property and have no value outside the game: they cannot be sold, traded, gifted, moved to another player’s account, or exchanged for money or for anything else.
Packs are random, and what protects you
Which cards a pack holds is decided by chance, weighted by rarity, at the moment you open it. So that you know what you are paying for:
- The odds are published. Every pack’s page links to them, and you can read them before you buy.
- The rarest cards are guaranteed in the end. Each kind of pack promises a card of the highest rarity within a stated number of packs of that kind. The number is on the pack’s page.
- You are not sold what you already have. A pack does not give you a creature you already hold two of while there are others of that rarity you still need. Once there are none, a spare copy is turned into amber for you.
- Nothing is only for sale. Packs are also earned by playing, and any single card can be made with amber.
Price and payment
The price is the one shown when you buy, in your currency. The store shows any tax it charges where you live before you confirm. Prices can change from time to time; a change never affects something you have already bought.
Amber
Amber is the game’s own currency. It is earned by playing and is never sold. It can be spent on packs and cards inside the game. It has no cash value and cannot be bought, sold, moved to another player or exchanged for money.
When you get it
A pack you buy is added to your account straight away, still sealed, and it stays sealed until you choose to open it. Sign in to the game so that what you buy is kept with your account and comes with you to another device.
If a pack you paid for has not arrived, restart the game. If it is still missing, write to us with the receipt the store sent you and we will put it right.
Changing your mind
A sealed pack can be refunded. An opened one cannot.
If you bought a pack by mistake, or thought better of it, and have not opened it, you can have your money back. Ask the store you bought it from, through its own refund process and within its time limits; the store pays the refund to the way you paid, and the pack leaves your account. A bundle is one purchase, so it can be refunded while all of its packs are still sealed.
Opening a pack reveals its cards and adds them to your collection. The pack has then been used, and it cannot be refunded because you would have liked different cards. The law normally gives you 14 days to cancel something bought online; for digital content that right ends once the content has been supplied to you. By opening a pack you ask for its contents at once and accept that you can no longer cancel that purchase.
If something is wrong with it
What you buy must be as described, fit for its purpose and of satisfactory quality. If a pack did not arrive, would not open, or did not contain what its page promised, tell us and we will repair or replace it. If we cannot, you are entitled to some or all of your money back.
Nothing in these terms takes away the rights the law gives you as a consumer, in the United Kingdom under the Consumer Rights Act 2015, or under the consumer law of the country you live in.
If you are under 18
You need the permission of a parent or guardian before buying anything, and it is their payment method that will be charged. Steam, Apple and Google all offer parental controls that can require approval for a purchase or block purchases altogether.
If a child has bought something without permission, ask the store first, because it holds the payment, and write to us if you need help.
Where packs are sold
Some countries do not allow items with random contents to be sold for money. In those countries packs are not offered for sale. They can still be earned by playing.
Changes to the game
Habitat is updated from time to time. An update can add cards, or change how a card works so that the game stays fair to play. The cards you own remain yours to use in the game through those changes.
Fair use
We may refuse or restrict purchases on an account where there has been fraud, or misuse of the refund process.
Complaints, and the law that applies
If you are unhappy with a purchase, write to contact@habitattcg.com and tell us what happened. We would much rather put it right than argue about it.
These terms are governed by the law of England and Wales. Wherever you live, you keep the protection of the consumer laws of your own country, and you can bring a claim in your local courts.
Changes to these terms
If these terms change, the date below changes with them. A purchase is always covered by the terms that were published on the day it was made.
